Please read these terms carefully before using TenantCheck.mt. By accessing or using the platform, you agree to be bound by these terms.
Welcome to TenantCheck.mt (the “Website” or “Platform”). These Terms of Use govern your use of the Platform. If you do not agree with these Terms, you must not use the Platform.
The Platform is intended to support safer and more transparent rental relationships in Malta by allowing eligible users to submit, access, and manage tenancy-related information in a restricted environment.
The Platform is not a public blacklist, credit reference agency, legal advice service, or court. Information made available through the Platform must not be treated as a final legal finding, professional advice, or a substitute for independent assessment.
Access to tenant-related information is restricted to eligible users, such as verified landlords, property managers, or tenants, subject to account checks, platform rules, and applicable law.
We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679, the Malta Data Protection Act, and other applicable laws.
For core platform processing involving tenancy-related reviews or information submitted about named tenants, the Platform will rely only on a lawful basis that has been assessed and documented by the operator. Where we rely on legitimate interests, this will be supported by a Legitimate Interest Assessment (“LIA”) covering the purpose of processing, necessity of the processing, and the balance between the Platform’s interests and the rights and freedoms of affected individuals.
We may suspend, restrict, delay, or refuse the acceptance or publication of tenant-related reviews where required to complete compliance checks, an LIA, identity verification, notification procedures, dispute handling, or regulatory engagement.
User warranties in these Terms do not replace our own obligations as controller to identify, document, and demonstrate a lawful basis for our processing activities.
Before accepting or publishing further tenant-related reviews, we may conduct and document a formal Legitimate Interest Assessment for the relevant processing activity.
We may also engage proactively with the Office of the Information and Data Protection Commissioner in Malta where appropriate, including to present our processing model, notification process, access restrictions, moderation safeguards, and platform architecture.
If our assessment indicates that a proposed processing activity would create an unjustified risk to individuals, we may modify, restrict, suspend, or discontinue that activity.
Where a landlord or authorised user submits a review or other information about a named tenant, the Platform may require sufficient contact details to notify the affected tenant that personal data about them is being processed.
Notification may take place at or shortly after submission and before publication where required. The notice may explain who is processing the data, the categories of data submitted, the purpose of processing, the lawful basis relied upon, the tenant’s rights, and how to contact us.
We may refuse or delay review publication where we cannot reasonably provide required transparency information, complete identity checks, or satisfy applicable data protection requirements.
Tenants may contact us to request access, correction, deletion, restriction, objection, or review of information concerning them.
You must be at least 18 years old to use the Platform. You must provide accurate account information and keep your login credentials secure.
Access to tenancy-related reviews, tenant information, and landlord review functionality is restricted and not publicly available.
Users may be required to complete identity verification, landlord verification, property ownership verification, tenancy relationship verification, or other reasonable compliance checks before accessing restricted areas of the Platform.
Verified Landlord Accounts
Only verified landlords or other authorised verified users approved by the Platform may:
Free or Basic Accounts
Users who register only a free or basic account without completing verification checks will not be permitted to access tenant reviews, detailed tenant-related information, or restricted tenancy-review search functionality.
Basic account registration alone does not grant access to tenant review data or restricted review systems.
We reserve the right to approve, reject, suspend, restrict, or revoke verification status or access privileges at our discretion where necessary for security, legal compliance, moderation, fraud prevention, or protection of affected individuals.
By submitting any content to the Platform, you confirm that:
You remain responsible for the content you submit. However, this responsibility does not remove or replace the Platform operator’s own data protection obligations.

Submission of a review does not guarantee publication. We may review submitted content before or after publication to assess compliance with these Terms, our Privacy Policy, data protection law, defamation risk, and platform safety rules.
We may edit, redact, restrict, reject, unpublish, or remove content where it appears excessive, inaccurate, unsupported, unlawful, unfair, defamatory, or otherwise unsuitable.
Where content is disputed by a tenant or affected individual, we may temporarily restrict visibility while the matter is reviewed.
Moderation decisions may take into account evidence, user verification status, platform rules, legal obligations, data protection rights, and fairness to affected individuals.
The Platform may allow verified landlords or authorised users to request tenancy-related questionnaire information from prospective or current tenants through restricted-use forms, invitation links, or private assessment requests.
Questionnaire data may include information reasonably relevant to tenancy assessment, such as:
Users must not request or submit excessive, discriminatory, irrelevant, or unlawful personal data. The Platform may restrict, redact, or prohibit certain categories of information where necessary for compliance, moderation, fairness, or data minimisation purposes.
Questionnaire information may only be used for legitimate tenancy-related assessment purposes and must not be reused for unrelated purposes, profiling, discrimination, public disclosure, or external databases.
Questionnaire data may be subject to access restrictions, moderation controls, automatic deletion schedules, and retention limits in accordance with the Privacy Policy and applicable law.
Prospective tenants completing questionnaires may be provided with privacy and transparency information explaining how their information will be processed.
The Platform may allow verified and authorised users to create optional search alerts relating to tenancy-related review searches.
Search alerts are intended only to notify authorised users if future tenancy-related review information matching a previous search becomes available on the Platform.
Search alerts are not intended to operate as covert monitoring, unlawful surveillance, profiling systems, background investigation tools, or tracking systems targeting individuals.
Search alerts remain subject to applicable data protection, transparency, moderation, notification, lawful-use, and fairness requirements.
The Platform may restrict, suspend, anonymise, disable, or remove search alert functionality where necessary for compliance, moderation, legal obligations, fraud prevention, security, or protection of affected individuals.
The Platform operates an internal dispute and complaint-handling process intended to allow tenants, landlords, users, or affected individuals to challenge or report content, moderation decisions, data protection concerns, or alleged unlawful activity.

We may acknowledge complaints, request supporting evidence, temporarily restrict visibility of disputed content, contact relevant users, or take moderation action while a matter is reviewed.
We aim to review disputes and complaints within a reasonable timeframe. More serious, urgent, or legally sensitive matters may receive prioritised review.
Where appropriate, affected individuals may escalate unresolved complaints to competent authorities, including the Office of the Information and Data Protection Commissioner (IDPC) or the Malta Communications Authority (MCA).
Any person may report content they believe to be unlawful, inaccurate, defamatory, abusive, privacy-infringing, discriminatory, fraudulent, misleading, or otherwise in breach of applicable law or Platform rules.

Following receipt of a report, we may acknowledge the notice, investigate the matter, request additional information, temporarily restrict visibility, or remove content where appropriate.
Serious, urgent, or high-risk reports may receive prioritised review.

A tenant or other affected individual may contact us if they believe that information about them is inaccurate, outdated, unfair, excessive, unlawful, or misleading.
Depending on the circumstances, affected individuals may request access, rectification, erasure, restriction, objection, or other rights available under data protection law.
We may request identity verification before responding to a request. We may also contact the submitting user for clarification or supporting information.

We may carry out checks or moderation, but we do not guarantee that all user-submitted content is complete, accurate, verified, or up to date.
Content reflects user-submitted experiences or information and should not be treated as a final factual, legal, or professional determination.
Tenant-related information available through the Platform is not publicly accessible and is intended only for restricted use by verified and authorised users with a legitimate tenancy-related purpose.
Users must not use Platform information:
The Platform may log, monitor, review, restrict, or investigate account activity and searches for security, moderation, fraud prevention, legal compliance, and protection of affected individuals.
We may suspend or permanently ban accounts that misuse tenancy-related information or attempt to access restricted data without authorisation.

The Platform does not guarantee that all user-submitted content is accurate, complete, lawful, verified, or up to date. Users remain responsible for their own decisions, assessments, and actions.
However, nothing in these Terms excludes or limits liability for:
Nothing in these Terms affects rights available to consumers or data subjects under applicable law, including rights arising under consumer protection, data protection, defamation, or platform-regulation laws.
The Platform hosts user-generated content submitted by users. While we may carry out moderation, verification, or compliance checks, we do not automatically endorse or adopt user-submitted statements as our own.
We operate a notice-and-action process intended to allow individuals to report content that may be unlawful, inaccurate, misleading, defamatory, excessive, abusive, or in breach of applicable law or Platform policies.

We reserve the right to take moderation or enforcement action where necessary to comply with legal obligations, data protection law, the Digital Services Act, or Platform safety and integrity requirements.
Personal data and tenancy-related review information will not be retained longer than necessary for the purposes for which it was collected and processed.

The Platform may use automated retention and deletion systems to help ensure that outdated, unnecessary, or expired information is removed or anonymised in accordance with applicable law and Platform policies.

The Platform may contain links to third-party websites. We are not responsible for the content, accuracy, or privacy practices of external sites.
We may update these Terms from time to time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Malta. Any disputes shall be subject to the jurisdiction of the Maltese courts.
